This is a legal agreement between you (the person viewing, using or accessing the Platform, referred to as "You" or "User") and GateRakshak ("Company", "we", "us", or "our").
Please read these Terms & Conditions carefully before using the services offered by GateRakshak. These Terms set forth the legally binding terms and conditions for your use of the GateRakshak website, gaterakshak.com, and the GateRakshak mobile applications (together, the "Platform"), and any sub-domains and the services, features, or content available through the Platform (collectively referred to as the "Service(s)"), which includes an information-technology platform for providing visitor management, community management, security, and accounting services to apartment complexes, residential societies, and gated communities ("Designated Premises").
By registering for and/or using the Service in any manner, you agree to all of the terms and conditions contained herein ("Terms"), which also incorporate GateRakshak's Privacy Policy and all other operating rules, policies and procedures that may be published from time to time by GateRakshak, each of which is incorporated by reference. These Terms apply to all users of the Service.
Subject to these Terms, GateRakshak may offer to provide the Services as described on the Platform, solely for your own use in connection with your registered housing society, and not for the use or benefit of any third party.
3.1 You are required to register with GateRakshak to use the Service. You shall provide GateRakshak with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of these Terms, which may result in immediate termination of your GateRakshak account.
3.2 You shall not select or use as a username a name of another person with the intent to impersonate that person, or use a name that is offensive, vulgar or obscene. GateRakshak reserves the right to refuse registration of, or cancel a username in its sole discretion.
3.3 You are solely responsible for all activity that occurs on your account and for maintaining the confidentiality of your GateRakshak password. You shall never use another user's account without such other user's express permission. You will immediately notify GateRakshak in writing of any unauthorised use of your account.
3.4 You represent and warrant that you are of legal age (18 years or above) to form a binding contract, or that if you are registering on behalf of a society or entity, you are authorised to enter into and bind the entity to these Terms.
3.5 If you provide any information that is untrue, inaccurate, not current or incomplete, GateRakshak has the right to suspend or terminate your account and refuse any and all current or future use of the Service.
4.1 All content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such content. GateRakshak does not control, and has no duty to take any action regarding how you may interpret or use the content.
4.2 The Platform contains content specifically provided by GateRakshak or its partners, which is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. You shall abide by and maintain all copyright notices, information, and restrictions contained in any content accessed through the Service.
4.3 GateRakshak grants each user of the Platform a worldwide, non-exclusive, non-sublicensable and non-transferable license to use the content, solely for personal, non-commercial use in connection with the management of their registered society.
5.1 By submitting content on the Platform (including notices, complaints, comments, or any other data), you grant GateRakshak a worldwide, non-exclusive, royalty-free license to use, copy, modify, reproduce, and distribute such content in connection with operating and improving the Platform and Services.
5.2 You retain ownership of any content you submit. The license grant to GateRakshak does not affect your other ownership or license rights in your submissions.
6.1 As a condition of use, you agree not to use the Service for any purpose that is prohibited by these Terms. You are responsible for all of your activity in connection with the Service.

The Service may permit you to link to other websites or resources on the internet. When you access third-party websites, you do so at your own risk. GateRakshak is not responsible or liable for the content, accuracy, legality, or appropriateness of such websites or resources, and the inclusion of any such link does not imply endorsement by GateRakshak.
8.1 Certain Services may be subject to subscription or usage-based payments ("Paid Services"). Payment terms presented to you in the process of using or signing up for a Paid Service are deemed part of these Terms.
8.2 We use third-party payment processors to bill you through a payment account linked to your GateRakshak account. The processing of payments is subject to the terms, conditions and privacy policies of the Payment Processor in addition to these Terms. GateRakshak is not responsible for errors by the Payment Processor.
8.3 The terms of your payment will be based on your chosen Payment Method and may be determined by agreements between you and the relevant financial institution. If we do not receive payment from you, you agree to pay all amounts due upon demand.
GateRakshak may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate your account, you may do so by contacting us at support@gaterakshak.com. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
THE SERVICE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
GATERAKSHAK DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY SOFTWARE AVAILABLE AT OR THROUGH THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE PLATFORM, SERVICE AND CONTENT IS SOLELY AT YOUR OWN RISK.
ALL LIABILITY OF GATERAKSHAK, ITS DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, PARTNERS, OR CONTENT PROVIDERS FOR ANY LOSS SUFFERED AS A RESULT OF YOUR USE OF THE PLATFORM, SERVICE OR CONTENT IS EXPRESSLY EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW. IF LIABILITY IS DETERMINED BY A COURT OF COMPETENT JURISDICTION, THE TOTAL AGGREGATE LIABILITY OF GATERAKSHAK SHALL BE LIMITED TO THE LESSER OF (A) THE AMOUNT PAID BY YOU TO GATERAKSHAK FOR THE SERVICES IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY OR (B) RUPEES FIVE THOUSAND (₹5,000).
You shall defend, indemnify, and hold harmless GateRakshak, its affiliates, and each of their employees, contractors, directors, and representatives from all losses, costs, claims, damages, expenses (including reasonable legal costs) or liabilities that arise from or relate to your use or misuse of the Platform, violation of these Terms, or infringement by you of any intellectual property or other right of any person or entity.
These Terms shall be governed by and interpreted in accordance with the laws of India. You agree that courts in India shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
These Terms are the entire agreement between you and GateRakshak with respect to the Service and supersede all prior or contemporaneous communications and proposals between you and GateRakshak. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
GateRakshak reserves the right, at its sole discretion, to modify or replace any of these Terms at any time by posting a notice on the Platform or by sending you notice via email. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes. It is your responsibility to check these Terms periodically for changes.
GateRakshak will not be responsible for any delay or failure to comply with its obligations under these Terms if the delay or failure arises due to any event or circumstance beyond GateRakshak's reasonable control, including natural disasters, government actions, or communications failures.
This document is an electronic record in terms of the Information Technology Act, 2000 ("IT Act") and rules made thereunder. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of the IT Act and the rules made thereunder.
These Terms are personal to you and are not assignable or transferable by you without GateRakshak's prior written consent. GateRakshak may assign, transfer or delegate any of its rights and obligations hereunder without consent. No agency, partnership, joint venture, or employment relationship is created as a result of these Terms.
These Terms are published in the English language. If GateRakshak ever provides a translation for convenience, the English language version shall govern your relationship with GateRakshak and shall take precedence over any translation in the event of a contradiction.

These Terms contain the entire understanding of the parties with respect to the subject matter hereof, and there are no other written or oral understandings or promises between the parties with respect to the subject matter of these Terms other than those contained or referenced herein.
